In this document, “Volkswagen”, “we”, “us” and “our” means Volkswagen Group Australia Pty Ltd (ABN 14 093 117 876) trading as Volkswagen Australia. Volkswagen operates the website https://store.volkswagen.com.au ("Website").

These Terms of Use govern your access to and use of our Website. Please read these Terms of Use carefully, and contact us by emailing volkswagenstore@activgroup.io if you have any questions.

These Terms of Use must be read in conjunction with our Shipping Policy, Refund and Return Policy, and Warranty Policy. By using this Website and placing an order, you acknowledge and agree to the terms set out in these policies, which form part of your agreement with us. 1. Licence

We grant you a non-exclusive, royalty-free, revocable, worldwide, non-transferable right and licence to use our Website for your personal use in accordance with these Terms of Use.

2. Online Shopping Terms and Conditions

2.1 Ordering

• Whist we try to ensure that all listings of Volkswagen Genuine Accessories ("Accessories") and Volkswagen Lifestyle Merchandise ("Merchandise") on our Website are current, we do not warrant that all Accessories or Merchandise listed on our Website will be available at the time that you place your order (“Order”). We may withdraw or suspend any Accessories or Merchandise displayed on the Website, at any time, either temporarily or permanently. We will not be liable to you or any third party for any loss (direct and indirect) suffered as a result of the removal of any Accessories or Merchandise from the Website.
• You may place an Order for Accessories or Merchandise by selecting and submitting your Order through the Website.
• To place an Order via the Website, you must:
• be over 18 years of age;
• have a delivery address in Australia;
• provide us with a valid email address and telephone number; and
• provide credit or debit card details (for a card issued by a bank or financial services company acceptable to us or our payment processor).
• You must ensure that the information in your Order is accurate and complete. We accept no responsibility or liability for incorrect information used to complete your Order.
• Any Order placed through the Website is an offer by you to purchase the particular Accessories or Merchandise for the price notified on the Website at the time you place the Order.
• When you place an Order, we will send you an email confirming receipt of your Order to the email address that you provide. Once an Order is dispatched, we will send you a further email providing a tracking number so that you may track the delivery of your Order, unless you ordered a limited Volkswagen product directly from a Volkswagen Dealership.
• We do not process Orders until our payment processor confirms to us that it has received payment for the relevant Accessories or Merchandise.
• We reserve the right to accept or reject your Order for any reason, including if the Accessories or Merchandise are not available, if there is an error in the price or the Accessories or Merchandise description posted on the Website, or there is an error in your Order.
• Unless we notify you that we refuse your Order or that the Accessories or Merchandise that you have ordered are not available, our acceptance of your Order and the formation of a contract between us occurs when we approve your payment and we (or our payment processor) debit your debit or credit card.
• If the items in an Order are not available, we will contact you to see if you would like to place a back order or if you would prefer a refund.
• Accessories or Merchandise purchased are strictly for personal use. Purchase of any Accessories or Merchandise through the Website for resale to a third party or for any trade purposes is strictly prohibited. If we have any concerns regarding the number of Accessories or Merchandise that you have ordered, then we may contact you to verify your Order at the time of or soon after you place the Order for the Accessories or Merchandise. We otherwise reserve the rights to withhold shipment of your order until such time your verification has confirmed.

2.2 Shipping

2.3 Risk and Title

(a) Title for the Accessories and Merchandise you order will pass to you upon payment for the relevant item.

(b) Risk will pass to you at the time your Accessories or Merchandise are delivered to your nominated delivery address.

2.4 Pricing

(a) Prices for Accessories and Merchandise are as shown on the Website at the time you place the Order. All prices are in Australian ($AUD) dollars and are inclusive of GST.

(b) Prices may change from time to time without notice to you. We will fulfil your Order at the price listed at the time you placed your Order.

2.5 Returns

3. Warranty

   4.1 Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other foreseeable loss or damage only to the extent legally permissible. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure as defined in Schedule 2 of the Competition and Consumer Act 2010 (Cth).
   
   4.2 Without excluding, restricting or modifying any rights you may have under the Australian Consumer Law:

(a) you acknowledge that the Website is provided ‘as is’ and we do not make any warranty or representation as to the suitability of the Accessories or Merchandise for any purpose other than that which is expressly stated;
(b) images displayed on the Website are for illustrative purposes and the exact specifications may differ from photos; and

(c) we exclude all other implied terms and warranties, whether statutory or otherwise to the extent legally permissible.

5. Our intellectual property rights

If any provision of these Terms of Use is found to be illegal, invalid or unenforceable by a court of law in respect of a jurisdiction, then that provision will not apply in that jurisdiction and is deemed not to have been included in the Terms of Use in that jurisdiction. This will not affect the remainder of the remaining provisions.
